My Fast Web Hosting Terms and Conditions.

These Terms and Conditions govern the use of services provided by My Fast Web Hosting (“we”, “us”, “our”). By ordering or using our services, you agree to be bound by these terms and our integrated Privacy Policy.

1. About Us

My Fast Web Hosting is a UK-based provider of web hosting, domain registration, SSL certificates, and managed email services.

2. Eligibility & Account Registration

  • Legal Capacity: You must be at least 18 years old and possess the legal authority to enter into a binding agreement.
  • Accuracy: You must provide a valid email address and physical address. We reserve the right to request identity verification to prevent fraud.
  • Security: You are responsible for all activity under your account. You must notify us immediately of any unauthorized access.

3. Service Provision & Consumer Rights

  • Contract Formation: A contract is formed only upon our written confirmation or service activation. We reserve the right to refuse service to anyone for any reason.
  • Statutory Rights: If you are a consumer, you have a 14-day "cooling-off" period. However, by requesting immediate activation or accessing the control panel, you acknowledge that your right to cancel is waived once the service is provisioned.

4. Pricing, Payment & Renewals

  • Automatic Renewal: Services renew automatically at the end of each billing cycle unless cancelled 30 days in advance via the Client Area.
  • Late Payment: Failure to pay within 3 days of the due date may result in automated suspension. A reconnection fee may apply.
  • Price Changes: We may adjust pricing at any time. Existing customers will receive 30 days' notice via email before new rates apply.

5. Hosting Usage Limits & Acceptable Use Policy (AUP)

Our shared hosting plans are designed for standard websites, related email functions, and normal traffic levels. All plans (including those advertised as "unlimited") are subject to fair and reasonable usage.

5.1 Reasonable & Fair Usage

Resources such as CPU, RAM, disk I/O, processes, and bandwidth must be used in line with typical web hosting needs. Shared hosting accounts are subject to the following technical constraints:

  • Resource Bursts: Accounts may not consume more than 10% of total system resources for longer than 60 seconds. We reserve the right to kill any process that threatens server stability.
  • Inodes: Usage is limited to 250,000 inodes (files/folders) per account. Excessive file counts degrade system performance and backup reliability.
  • Email Sending: Outbound email is limited to 200 messages per hour to protect our IP reputation. Shared hosting is not for bulk marketing or newsletters.
  • Noisy Neighbors: We reserve the right to throttle or suspend any account that negatively impacts other users on the same server without prior notice.

5.2 Prohibited Activities & Content

The following are strictly prohibited. Breach of this policy may result in immediate termination without refund:

  • Resource Abuse: Crypto mining; persistent web crawlers/bots; automated high-volume mailing; real-time chat/game servers; and poorly optimised cron jobs.
  • Storage Misuse: Using hosting for offsite backups, personal file archives (e.g., cloud storage), security camera footage, or large repositories unrelated to an active, linked web page.
  • Proxies: Anonymous proxies, VPN services, or any anonymisation software.
  • Network Abuse: DoS/DDoS tools; port scanning; black-hat SEO; spamdexing; or running search engines/indexing services.
  • Spam: Sending or relaying unsolicited bulk email (spam), phishing, or harvesting data without consent.
  • Illegal Content: Child exploitation material; copyrighted content without rights (piracy); hacking tools; malware distribution; and unauthorised investment/FOREX schemes.
  • Distribution Hubs: BitTorrent clients/trackers; firmware or system image hosting; binary payload delivery; and automated machine-to-machine file distribution (FTP/SFTP/SSH).

6. Data, Backups & GDPR

  • Backups: While we perform routine backups for disaster recovery, you are responsible for maintaining your own offsite backups. We provide no guarantee of data integrity.
  • Data Processing: We process personal data in accordance with the UK GDPR. You act as the Data Controller for your website's users; we act as the Data Processor.

7. Uptime & Support

  • Uptime Goal: We aim for 99.9% uptime, excluding scheduled maintenance. This is a target, not a legally binding guarantee.
  • Scope of Support: Support is limited to server-side issues (DNS, hardware, connectivity). We do not provide coding support, debugging for third-party plugins, or web design services.

8. Limitation of Liability & Indemnity

  • Disclaimer: Services are provided "as is." We are not liable for lost profits, loss of data, or indirect damages arising from downtime or service suspension.
  • Cap: Our total liability is limited to 100% of the fees paid by you for the specific service during the 12 months preceding the claim.
  • Indemnity: You agree to indemnify us against all claims, damages, and expenses resulting from your content or breach of these terms.

9. Termination & Cancellation

  • By You: Cancellations must be submitted via the Client Area. No refunds are provided for domains, SSL certificates, or dedicated services once provisioned.
  • By Us: We may terminate service immediately for AUP violations. Upon termination, all customer data will be permanently deleted after 30 days.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
